Can't FTP up new file w'out Always Overwrite Without Prompt

2008.06b. I have noticed that my FTP connection (passive mode) will not upload a file which is not already on the FTP server unless "Always Overwrite Without Prompt" is selected on the last Copy popup window. Filezilla Server output log suggests it is the LIST /<fname> that occurs when the option is not set. It only seems to pass that test if the filename already exists. Unfortunately there is no error detected at the FC end (until you do a directory listing).
