Steps to reproduce.
1. Sort the items by name
2. Click on the structureless view.
3. Click again in the structureless view.
4. The items are no longer the same as they were before.

Using Windows 10 Pro (Build 19044)

I can't reproduce with default settings.

If you're using Automatic views, disable this option.

If you want to use Automatic views, open Settings - F12, View, Column profiles/Automatic views, Auto selectable views, enable option "Switch view mode automatically on folder change" and set your preferred sorting option for "<Defauls view>", e.g. Sort on - Name - Ascending.

I do indeed have auto views for plain files.

Should it still not remember the previous state of the views when toggling it off?

With default settings, when auto views are off, the last used sorting is used.

When auto views are on, default view option is used, if any other condition can't be used.

I think it's a normal behavior.

Workaround - you can use "lock view" to use last used view, use your custom view sorting, lock view, enable plain view, disable plain view, last used sorting is used..

I've disabled the sorting of the items for the time being.

I'll try your suggestion if that doesn't work so well.
