freecommander 2009 + winXP-SP3 sometimes doesnt keep settings for "ask/no ask" menu option in Confirmations/"Assign to menu item copy" and "... move".

Sounds to me like a corrupt install. Have you tried a new ini file created with the start-up switch /Ini= (see http://www.freecommander.com/fc_faq_en.htm for more info.
